Terms of Service

Last updated: October 29, 2026

Welcome! These terms explain the rules for using the Upper Cumberland Digital website. We’ve kept them short and in plain English. By using this website, you agree to these terms.

Who we are

Upper Cumberland Digital is a small, locally owned business in DeKalb County, Tennessee. We help local businesses with missed-call text-back (an automatic text sent to a caller when a business misses a call), online booking, review requests, websites, and Google Business Profile help. When these terms say “we,” “us,” or “our,” they mean Upper Cumberland Digital. “You” means anyone using this website.

Using this website

You’re welcome to browse, read, and contact us. Please don’t misuse the site. That means no trying to hack it, overload it, send spam through it, or use it for anything illegal.

This website is general information, not a contract

The website describes our services in general terms. It is not a contract and doesn’t create one. If you become a client, our work together is covered by the service agreement we both sign. If anything on this website disagrees with your signed service agreement, the signed service agreement wins.

Prices and offers can change

Prices, packages, and offers shown on this website can change at any time, and limited offers may run out. The price you pay is the one written in your signed service agreement or in a written quote from us. If you’re already a client, your service agreement explains how and when we can change your price.

When you send us a message

When you use our contact form or email us, your message comes straight to us. We use what you send only to reply to you, set up a call you asked for, or send you a quote. We won’t sell your information, and we won’t add you to a mailing list or send you spam. Sending a message doesn’t sign you up for anything or commit you to buying anything. For more details, see our Privacy Policy.

Text messages

If you text our business number, or a demo number we give you to try missed-call text-back, we’ll text you back about your question or the demo. Message frequency varies. Message and data rates may apply. Reply STOP at any time to stop getting texts from that number, and reply HELP for help. You can also reach us at [email protected]. Agreeing to get texts is never a condition of buying anything from us. Phone carriers aren’t responsible for delayed or undelivered messages. We don’t sell or share your phone number with anyone else for their marketing.

If you got a text from one of our clients’ businesses (for example, after you called them and they missed it), that business sent it using our tools. Reply STOP to that number to stop those texts, or contact that business directly.

Our content

The words, designs, logos, product names, and pictures on this website belong to Upper Cumberland Digital (or are used with permission). Please don’t copy them or use them for your own business without asking us first. Sharing a link to our site is always fine.

No guarantees

We work hard to help our clients, but we can’t promise any particular result, such as a certain number of calls, customers, reviews, or sales, or a certain spot in Google search results. We try to keep this website accurate and working, but it’s provided “as is,” and we can’t promise it will always be error-free or available.

Limits on our responsibility

To the fullest extent the law allows, we aren’t responsible for any loss that comes from using this website or relying on its information, including lost profits or lost business. If you’re a client, the limits in your signed service agreement apply to our services.

Links to other websites

Our website may link to other websites, such as Google. We don’t control those sites and aren’t responsible for what’s on them or how they handle your information.

Tennessee law and where disputes go

These terms are governed by the laws of the State of Tennessee. If there’s ever a dispute, it will be handled in the courts of DeKalb County, Tennessee. Of course, we’d much rather just talk it out first, so please reach out.

Changes to these terms

We may update these terms from time to time. When we do, we’ll post the new version here and change the “Last updated” date at the top. Updates to this page don’t change a service agreement you’ve already signed.
